Healing with TANIA

Terms and Conditions:

By purchasing any session (“Session”) of “Healing with Tania”

from Tania Villegas (“Tania”), you (“Client”) agree to the

following terms.

All prices are listed in U.S. Dollars and are subject to change

without notice. All sales are final.

By purchasing a Session, Client agrees with the following

terms and conditions ("Terms and Conditions”), a legally

binding agreement between Client and Tania.

1. TERMS.

(a) Client agrees to be provided with services for the Session

by Tania according to these Terms and Conditions.

(b) Tania agrees to provide the Services to Client in

accordance with the industry standards applicable to the

Services.

(c) Tania reserves the right to substitute services equal or

comparable to the Services for the Services at its sole

discretion if reasonably required to do so by prevailing

circumstances, including, without limitation, requirement by

related laws and regulations, increase of the cost to provide

the Services, and the spread of COVID-19 or other diseases.

(d) Client agrees to be present and prepared to complete the

Services. Client is solely responsible for his/her own success

and implementation of his/her objectives in connection with the

Services.   

(e) Client understands and agrees that Tania does neither

solve medical issues nor treat disease and is therefore not a

replacement for Client’s doctor, physician, psychologist,

therapist, or any other medical care providers, as specifically

clarified in Section 3 of these Terms and Conditions. If Client is

presently under any form of psychiatric care, psychological

therapy, specialized medical supervision, or under the

influence of any form of medication, Client shall inform Tania

prior to the Session.

(f) Client is responsible to check the schedule and status of the

Session to avoid missed/any unused Sessions. Tania is neither

required to refund any portion of the fees for missed or unused

Sessions nor provide a substitute session, unless Client

requests to reschedule the Session prior to twenty-four (24)

hours before the scheduled Session, as set forth in Section 4

of these Terms and Conditions.

(g) Client agrees to comply with and be bound by the Safety

Protocol, the Code of Conduct, and any other rules established

by Tania.

(h) Client under the age of eighteen (18) should have consent

from a parent or legal guardian who agrees to be bound by

these Terms and Conditions.

(i) Client agrees to a travel fee on top of what the rate is for having Tania come to your location for your ease and convenience.

2. METHODOLOGY.  Client agrees to accept Tania’s methods

to provide the Services and partake in the methods proposed.

Client understands and agrees that Tania has made no

guarantees as to the outcome of the Sessions. Tania may

revise methods or parts of the Services based on the needs of

Client but at its sole discretion.  

3. DISCLAIMER.  Client understands, acknowledges, and

agrees that Tania is not a medical doctor, physician,

psychologist, therapist, or any other medical care provider, is

not medically qualified, is not a substitute for a qualified doctor,

physician, psychologist, therapist, or any other medical care

provider, does not warrant the accuracy of any information

provided, and is not liable for any losses or physical injury

Client may suffer by following Tania’s advice.

Client understands, acknowledges, and agrees that the

information provided during the Sessions is neither intended

nor implied to be a substitute for medical advice.  Tania may

provide Client with information relating to products and/or

services that Tania believes might benefit Client, but Client

understands, acknowledges, and agrees that such information

is not an endorsement or recommendation.

4. PAYMENT, REFUND POLICY AND CANCELLATION.

(a) Client agrees to pay Tania a 50% non-refundable deposit

upon purchasing a Session. The balance of the fees for the

Services will be charged upon the appointment date when the

Services are provided, as stated in Section 4(b) below. Client

may pay in full upon purchasing a Session.

(b) Client may cancel the Services if Client notifies Tania of

his/her intention of cancellation prior to twenty-four (24) hours

before the scheduled Session, in which case the balance of the

fees for the Services is not charged. For the avoidance of

doubt, 50% deposit Client pays upon purchasing a Session is

not refundable, regardless of the previous sentence in this

section. The balance of the fees for the Services is charged

upon the appointment date when the Services are scheduled to

be provided unless Client notifies the Business of his/her

intention of cancellation prior to twenty-four (24) hours before

the scheduled Session, even if Client misses part or whole of

the Session for any reasons.

(c) Client may reschedule the Services if Client notifies Tania

of his/her intention of rescheduling prior to twenty-four (24)

hours before the originally scheduled Session, in which case

the balance of the fees for the Services is charged upon the

rescheduled date when the Services are provided.

(d) Except for the cases stated in Sections 4(b) and 6 in these

Terms and Conditions, Tania does not refund any portion of the

fees for the Services to ensure that Client is fully committed to

the Sessions, unless required by applicable law, which may

include permitted cancellation in the event of death and/or

disability.

(e) If Client has selected a “Prepaid Package” option, Client

understands and agrees that the package Client purchased has

an expiration date below: (1) If Client purchases a 5-classes

package, the package expires on thirty-five (35) days after the

purchase date of the package; and (2) if Client purchases a

10-classes package, the package expires on seventy (70) days

after the purchase date of the package. 

5. INTELLECTUAL PROPERTY RIGHTS.  Tania owns and

maintains all of the copyright and other intellectual property

rights, and ownership of data and/or information, used or

subsisting in the Services and materials provided to Client in

connection with the Services, whether finished or unfinished.

Nothing in these Terms and Conditions shall be interpreted to

transfer ownership of or rights to any intellectual property of

Tania, and/or ownership of data and/or information of Tania, to

Client, nor grant any right or license to Client other than those

stated in these Terms and Conditions.

6. RIGHT TO TERMINATE. Tania may cancel the Sessions at

any time at its sole discretion, in which case Tania will refund

the fees for any part of the Sessions or prepaid packages not

completed at the time of the cancellation. For the avoidance of

doubt, 50% deposit Client pays upon purchasing a Session is

not refundable, regardless of the previous sentence in this

section.

7. RIGHT TO CHANGE. Tania reserves the right to modify or

add to these Terms and Conditions at any time, effective as of

the posting of the new terms or a later date as may be

specified in the new terms. Client agrees that Tania may notify

Client of the new terms by making them available via its

website, and that Client’s use of the Services after the effective

date of the new terms constitutes Client’s agreement to such

new terms.

8. GOOD FAITH. Each party represents and warrants to the

other that such party has acted in good faith, and agrees to

continue to so act, in the negotiation, execution, delivery,

performance, and any termination of these Terms and

Conditions.

9. DISCLAIMER OF WARRANTIES. The information Tania

provides to Client under these Terms and Conditions is

provided on an “as-is” basis, without any warranties or

representations express, implied, or statutory, including,

without limitation, warranties of quality, performance, non-

infringement of third-party’s right, merchantability, or fitness for

a particular purpose.

10. LIMITATION OF LIABILITY. Client understands,

acknowledges, and agrees that, to the fullest extent permitted

by applicable law, Tania shall not be liable to Client or any

other party for any claims, demands, damages, or causes of

actions due to injury to Client or any property, including,

without limitation, personal, bodily, or mental injury, economic

loss or any damage to Client, his/her spouse or partner, guest,

unborn children or relatives, arising out of or in connection with

Client’s engagement in any Sessions, regardless of whether

the injury or damages were caused by the negligence of Tania.

Client agrees that use of the Services is at Client’s own risk.

Client understands and agrees that participation in the

Services involves the risk that Client may contact and/or suffer

from COVID-19 or other diseases. Client understands and

assumes full responsibility of such risks. Tania is not

responsible for and Client releases Tania from any damages

even if Client suffers from COVID-19 or other diseases

because of the Services.

11. DISPUTE RESOLUTION.  The parties agree to try to

resolve any dispute arising under these Terms and Conditions

by an online mediation service that is agreed upon by the

parties or by a mediation in California with a mediator agreed

upon by the parties in good faith prior to pursuing any other

available legal or equitable remedies. In the event a dispute is

not solved by a mediation, the parties agree to submit to

mandatory binding arbitration in Los Angeles, California any

and all claims related to the dispute, and thereby further waive

any rights to trial by jury. If a dispute is litigated in an

arbitration, the non-prevailing party is responsible for the

prevailing party’s attorneys’ fees, in addition to any other relief

to which the prevailing party may be entitled. In the event the

arbitration results in a split-decision, each party shall be

responsible for its own attorneys’ fees and other legal cost,

and the parties are jointly responsible for the cost of the

arbitrator(s).

12. GOVERNING LAW. The parties agree that these Terms

and Conditions shall be governed by and construed in

accordance with the laws of California.

13. ENTIRE AGREEMENT. These Terms and Conditions

contain the entire agreement between the parties and

supersedes all prior agreements between the parties, whether

written or oral.

We recommend that Client contacts Tania if he/she has any

questions prior to purchasing.

Safety Protocol:

1. IMPORTANT: If Client is feeling unwell, exhibiting

symptoms of COVID-19 (which can include, without

limitation, fever, cough, shortness of breath or

difficulty breathing, chills, repeated shaking with

chills, muscle pain, headache, sore throat, new loss of

taste or smell), have been in contact with someone

who has tested positive for COVID-19, or have recently

tested positive for COVID-19, CONTACT ME

IMMEDIATELY.

2. Because I will be working in Client’s home or space, I ask

that the room we practice in and all the equipment we use

are safe, sanitized, and disinfected, including, without

limitation, floors, mats, blocks, and yoga blankets. This is

to avoid the spread of COVID-19 and other virus.

3. Please be advised I no longer touch Client in our

Sessions. Client shall maintain proper social distance from

me during the Services.

4. I appreciate Client’s support in keeping each other safe so

I can continue serving you effectively.

Code of Conduct:

1. All forms of sexual harassment are unethical. Sexual

harassment is defined as, but not limited to, repeated

comments, gestures, or physical contact of a sexual

nature. All forms of sexual behavior with clients are

unethical, even when a client invites or consents to

involvement in such behavior. Sexual behavior is defined

as, but not limited to, all forms of overt and covert

seductive speech, gestures, and behaviors in addition to

any physical contact of a sexual nature.

2. I provide rehabilitative instruction only for those problems

or issues that are within the reasonable boundaries of my

competence.

3. I establish and maintain appropriate professional

relationship boundaries.

4. I cultivate an attitude of humanity in my teaching.

5. I recognize the trust placed by the student in the teacher

and the power that gives the teacher. While

acknowledging the complexity of relationships, I avoid

exploiting the trust and dependency of clients. I avoid dual

relationships with clients (e.g., business, close personal or

sexual relationships) as I acknowledge that they can

easily impair my professional judgment, compromise the

integrity of my instructions and/or become a means for my

own gain. I never engage in harassment, abusive words,

actions, or exploitative coercion of clients or former

clients.
